Aikya Mart operates as a software marketplace platform under applicable Indian law. Product sale terms, payment collection and delivery execution are primarily handled by vendors unless explicitly stated otherwise.

1. Acceptance, Eligibility and Account Responsibility

  • By accessing or using Aikya Mart, you agree to these Terms and all applicable policies published by Aikya Mart.
  • You must be legally competent to enter into binding obligations under applicable law; if acting for a business entity, you represent authority to bind that entity.
  • Users and vendors must provide accurate information, maintain credential confidentiality, and remain responsible for all activity under their accounts.
  • If you do not agree to these Terms, you must stop using the platform.
  • Users and vendors must comply with applicable Indian law, including consumer, tax, data protection and information technology laws as relevant to their activity.

2. Platform Nature and Transaction Boundaries

  • Aikya Mart provides technology infrastructure connecting customers and vendors; Aikya Mart is not the seller of listed goods and is not a party to each sale contract.
  • Payments are handled directly between customer and vendor (or their selected payment channels). Aikya Mart is not a payment aggregator, escrow agent or settlement intermediary.
  • Delivery, cancellation, return and refund commitments are primarily determined and executed by the vendor, subject to vendor policy and applicable law.
  • Nothing in these Terms creates an agency, partnership, joint venture or fiduciary relationship between Aikya Mart and vendors for customer transactions.

3. Vendor and User Obligations

  • Vendors must ensure listing accuracy, lawful product/service sale, fair pricing disclosures and compliance with tax, consumer and local regulatory requirements.
  • Users and vendors must not post false information, manipulate reviews, impersonate others, or misuse platform communications.
  • Vendors are responsible for compliance with applicable consumer law disclosures, including obligations under Indian consumer/e-commerce laws where applicable.
  • Any off-platform arrangements remain at the sole risk and responsibility of the participating parties.

4. Prohibited Conduct, Suspension and Termination

  • Fraud, impersonation, unlawful content, abusive behavior, unauthorized access, scraping and policy evasion are prohibited.
  • Aikya Mart may remove content, suspend or terminate accounts, restrict access and preserve records for legal/regulatory purposes.
  • Serious violations may be referred to law enforcement or competent authorities.

5. Disclaimers, Limitation of Liability and Indemnity

  • Aikya Mart is not responsible for vendor inventory accuracy, product quality, fulfillment timelines or payment defaults between customer and vendor.
  • Users must attempt issue resolution with the vendor first and may escalate through Aikya Mart grievance channels where needed.
  • To the maximum extent permitted by law, platform services are provided on an 'as is' and 'as available' basis without warranties of uninterrupted or error-free operation.
  • To the extent permitted by law, parties using the platform agree to indemnify Aikya Mart for losses arising from their unlawful acts, policy breaches, or third-party rights violations.
  • Liability is limited to the maximum extent permitted by applicable law; nothing limits rights that cannot legally be excluded.

6. Governing Law and Dispute Resolution

  • These Terms are governed by applicable laws of India unless otherwise required by mandatory local law.
  • Before formal proceedings, parties should attempt good-faith resolution through Aikya Mart support and grievance channels.
  • Subject to mandatory consumer-law protections, disputes shall be subject to the courts having jurisdiction over the registered office location of Aikya Tech and Talent Solutions.
  • Nothing in these Terms limits statutory rights available to consumers under mandatory provisions of applicable law.
